By contracting our web hosting services, web domain registration, virtual private servers, dedicated servers, corporate email, design or development, web security, and any service we offer on our platforms, you accept our terms of use. This is to ensure the quality, security, continuity, and stability of our services.

These Terms of Use (usage policy) constitute a contract between the parties (the provider HABILWEB and the Client: the individual or company acquiring a service through our websites). This contract aims to establish the rules of use for the proper performance of the services and outline the duties that HABILWEB has as your provider of these services. Therefore, we ask that you read this document carefully and print it.

FIRST (OF THE PARTIES)

HABILWEB, a company providing IT services, specifically website hosting, corporate email, web design and development, web security, and domain registration, legally registered with Fundempresa, domiciled in Bolivia, with NIT 5574509014, hereinafter referred to as HABILWEB for the purposes of this contract, establishes a contractual relationship with any natural or legal person acquiring the services, hereinafter referred to as the CLIENT.

SECOND (OBLIGATIONS OF HABILWEB)

HABILWEB has the following obligations:

  • Maintain a constant hosting service with an UPTIME of 99.9%, providing adequate support when the CLIENT needs it from Monday to Friday during office hours via email, phone, tickets, or chat.
  • Safeguard the information/data on our servers with the highest security required by the client and the privacy they deserve in website hosting, documents, or email sending and receiving.
  • Perform constant updates to our client control system to improve functionality; as for cPanel system updates, these come with periodic security updates that will be carried out automatically for server stability.
  • HABILWEB commits to sending renewal reminders 30 days, 15 days, 3 days, and on the expiration or suspension date via email and SMS to inform the client of the renewal process. This is done through our system, which will provide a payment notice with the renewal amount.

Regarding domains, the duties of WebHosting.com.bo are:

  • Register domains in the name of the owners requesting registration with ICANN and verify the registration email for proper communication. For Bolivian domains, we handle the registration process with ADSIB (nic.bo), indicating the owner for proper future administration.
  • Notify clients 30, 15, and 3 days before domain expiration, and send a final email and SMS to the owner when the service is deactivated.
  • Offer support within 24 hours for registrations, renewals, or domain updates.
  • Regarding web hosting packages, prices, and features: HABILWEB is constantly improving to offer clients the best possible service. Web hosting prices remain and will remain as they were at the launch of our service, while service features may improve at any time without prior notice. Similarly, new services may be added, and others removed. Domain prices may increase by a percentage based on our ICANN provider each year.
  • After a domain name expires, we offer the domain owner 30 days to renew it. If not renewed during this period, the domain enters a 30-day waiting period for deletion. During these 30 days, the domain can still be restored by the current owner (but at a cost of $99 USD as a penalty from the DOMAIN PROVIDER). If the domain is not restored, it enters a pending deletion state for 30 days, after which it will be released for re-registration.
  • The .com, .net, and .org domain names are free for the first year with any contracted web hosting package, with charges applying only from the second year at the current rate.

Regarding billing:

HABILWEB complies with the legal issuance of invoices in Bolivia. For this purpose, the client’s name and NIT are requested via email at [email protected] after payment is made. The invoice will be issued digitally through the virtual billing service provided by the tax authority and sent to the client’s email in .PDF format, which can be printed.

All reminders, receipts, payment confirmations, or payment notices from the system are not invoices.

For virtual private server and dedicated server services, cancellation can only be requested with 10 days’ notice. If this period is exceeded, billing will continue into the next month. Please take note for server renewals, as our DataCenter providers use this advance payment method.

THIRD (OBLIGATIONS AND PROHIBITIONS OF THE CLIENT)

The obligations for shared hosting are established to ensure server stability, service quality, and client information security. Each cPanel account allows only:

  1. Sending a maximum of 200 emails per hour (from the entire cPanel account).
  2. In all our packages, there is only one automatic backup of 10GB; once this space is exceeded, the system stops automatic backups. (Servers no longer perform these backups, and the client must handle their own backup).
  3. Only 20 connections from the same IP are allowed.
  4. Only 5 simultaneous FTP account connections are permitted.
  5. Only 10% of the server’s overall CPU usage is allowed for shared hosting, or one assigned processor.
  6. RAM memory will be 1024MB per hosting account in shared hosting.
  7. No technical support will be provided for computers with Windows XP, Outlook Express, or other outdated systems.
  8. SPAM or unsolicited mass advertising to or from our servers, mass sending of newsletters, notifications, or any sending exceeding the allowed limit is prohibited.
  9. Using unlimited hosting accounts to store files/emails for a year is prohibited; storage is allowed for only 3 months for data such as archived emails or backups. For such cases, we recommend using our Cloud Storage/VPS/Dedicated Server service.
  10. Regarding the number of inodes, the limit per unlimited hosting account is 100,000 inodes.

Information Security and Cybersecurity

  1. Computer sabotage, forgery, scams, fraud, and anything classified as a crime under the Bolivian Penal Code or the laws of the contracting country is prohibited.
  2. Distribution of pirated software, illegal MP3s, viruses, trojans, hacking programs, links, phishing, compromised or harmful material affecting the proper functioning of our servers or third-party computers, and anything detrimental to our infrastructure, clients, or third parties is prohibited.
  3. All forms of pornography, adult content, or censored material on our shared hosting are prohibited, as they may damage the reputation of our servers.
  4. Any attack on or from our servers, abuse of malicious scripts, shells, exploits, bugs, etc., whether by manipulation or omission in the maintenance and updating of websites such as Joomla, WordPress, Drupal, PHPlist, Magento, PrestaShop, etc., that enable or facilitate malware infections on our servers, is prohibited.
  5. It is the CLIENT’s responsibility to maintain strong and updated passwords for access to the client system, cPanel, email, and devices interacting with our services.
  6. It is the CLIENT’s responsibility to maintain backups of their information (website) and email data at least once a month. If a service is suspended or deleted due to non-payment, HABILWEB will only store a backup for 30 days.
  7. It is the CLIENT’s responsibility to protect their website by updating, optimizing, and securing it with tools such as WAF, CDN, DNS, and others to keep it safe. While HABILWEB protects the server with antivirus and firewall, security flaws in the client’s website could compromise security and lead to an attack due to the CLIENT’s omission, potentially affecting our servers.
  8. Our servers are protected with Firewall/antimalware; in shared hosting packages, attacking countries are automatically blocked, and we provide DDoS protection.

Regarding email sending:

  • Mass email sending, whether advertising or notifications, is prohibited from shared hosting accounts.
  • The maximum storage capacity per email account is 3GB in shared hosting and unlimited hosting; in VPS or servers, this size can be modified.
  • If the client has contracted a VPS, it is their responsibility to keep the system updated and properly configured, with mailing lists verified by users through opt-in methods ensuring subscribers want to receive emails.
  • Under no circumstances should illegal content or content considered SPAM be sent.
All the above points are punishable by law and by HABILWEB with account cancellation without any right to claim or refund.

FOURTH (REFUND POLICY)

Every client is entitled to a refund within 30 days from the activation of their shared hosting account (our small hosting packages). Domain registrations are excluded from refunds, and if activated with a hosting account, this will be deducted from the refund.

Likewise, no refund will be issued if the client has violated the prohibitions in the THIRD clause.

There are no refunds for dedicated servers, virtual private servers, or cloud consulting services.

FIFTH (OF ACCEPTANCE)

The parties, HABILWEB and the contracting CLIENT, accept these terms of use, making it a private contract between them. By merely registering in our system and acquiring our services through it, they acknowledge their acceptance and that they do so of their own free will.
